Dear Ms. Beare:
This is in response to your request for an opinion on whether the deliberations of the Fair Housing and Appeals Board are subject to section 286.011, Florida Statutes, Florida's Government-in-the-Sunshine Law.
I have carefully examined the memorandums of law submitted by the Equal Employment Opportunity Commission and the Dade County Attorney's Office regarding this matter. The opinion expressed by Mr. Simon, that the Sunshine Law is applicable to deliberations of the Fair Housing and Appeals Board, is mandated by existing case law construing section 286.011, Florida Statutes. See and compare Canney v. Board of Public Instruction of Alachua County, 278 So. 2d 34 (Fla. 1973), and Department of Pollution Control v. Career Service Commission, 320 So. 2d 846 (Fla. 1st DCA 1975). Nothing contained in the opinion submitted by the Commission alters or changes this basic conclusion in any manner.
