The following are some of the more significant actions which occurred during the 2007 regular legislative session relating to the public's right of access to meetings and records.
Domestic Violence -- Personal identifying information contained in records documenting an act of domestic violence that is submitted to an agency by an agency employee seeking to take leave as provided therein is confidential and exempt. A written request for leave authorized under the statute (when the employee or a family or household member of an employee is the victim of domestic violence) which is submitted by an agency employee and any agency time sheet reflecting such request are confidential and exempt until 1 year after the leave has been taken. Florida Opportunity Fund -- Materials relating to the methods of manufacture, potential trade secrets, or patentable material received or generated through research by universities and other publicly supported organizations; information identifying investors or potential investors wishing to remain anonymous; information received from another state or federal government that is confidential under its laws; and proprietary confidential business information for alternative investments; held by the Florida Opportunity Fund and the Institute for the Commercialization of Public Research are confidential and exempt; portions of meetings of the board of directors of the fund or the institute at which such confidential information is discussed are exempt. In addition, certain information held by the Florida Technology, Research, and Scholarship Board is confidential and exempt as well as those portions of the meetings of the board at which confidential and exempt records are discussed. High School Drug Tests -- Records relating to drug tests under the Florida High School Athletic Association's random drug testing program and to the challenge or appeal proceedings are confidential and exempt; portions of a meeting at which such records are presented or discussed are exempt. Chapter 07-193, Laws of Florida, creating s. 1006.20(10), F.S.
St. Augustine Historic Preservation -- The identity of a donor or prospective donor to the direct-support organization authorized to assist the University of Florida in carrying out its dual historic preservation and historic preservation education purposes and responsibilities for the City of St. Augustine, who desires to remain anonymous, and all information identifying such donor or prospective donor, is confidential and exempt, and that anonymity must be maintained in the auditor’s report. Physician Workforce Surveys -- All personal identifying information contained in records provided by physicians licensed under chapter 458 or 459 in response to physician workforce surveys required as a condition for license renewal and held by the Department of Health is confidential and exempt, except as otherwise provided. Historic Landmarks -- Information identifying a donor or prospective donor to a publicly owned house museum designated by the United States Department of the Interior as a National Historic Landmark who desires to remain anonymous is confidential and exempt. Chapter 07-213, Laws of Florida, creating s. 267.076, F.S.
Sunshine State One-Call -- Proprietary confidential business information held by Sunshine State One-Call of Florida, Inc., for the purpose of describing the extent and root cause of damage to an underground facility or using the member ticket management software system is exempt. Chapter 07-101, creating s. 556.113, F.S.
Public Service Tax -- Repealed exemption for information received by a taxing authority or its agent in connection with an audit of public services taxes collected by a telecommunications service provider. Chapter 07-37, Laws of Florida, repealing s. 166.236, F.S.
Public Records Inspection and Copying -- Custodian or person having custody of public records may designate another officer or employee to permit inspection and copying of such records but must disclose the identity of the designee; custodian or designee must acknowledge requests to inspect or copy records promptly and respond to such requests in good faith. Chapter 07-39, Laws of Florida, amending s. 119.07(1), F.S.
Lifeline Assistance Plan Participants -- Personal identifying information of a participant in a telecommunications carrier's Lifeline Assistance Plan held by the Public Service Commission is confidential and exempt. Chapter 07-247, Laws of Florida, creating s. 364.107, F.S.
Workers' Compensation -- Certain records held by the Florida Workers' Compensation Joint Underwriting Association, Inc., are confidential and exempt and may only be released as prescribed therein; that portion of a meeting of the association's board of governors, or any subcommittee of the association's board, at which these records are discussed is exempt from open meeting requirements. Department of Insurance Workpapers and Investigative Reports -- Revises exemption for investigative records and workpapers of the department, including a provision that after the examination report filed or investigation is completed or no longer active, portions of workpapers may remain confidential. Chapter 07-249, Laws of Florida, amending s. 624.319, F.S.
U.S. Census Information -- U.S. Census Bureau address information held by an agency pursuant to federal law is exempt. Chapter 07-250, Laws of Florida, amending s. 119.071(1), F.S.
Economic Development Agency -- Revises exemption for trade secrets held by economic development agency and provides exemption for federal employer identification numbers, unemployment compensation account numbers, and Florida sales tax registration numbers held by such agencies as well as specified information held pursuant to the agency's administration of an economic incentive program for qualified businesses; repeals s. 288.1067, F.S.
