Weekly Message from Attorney General Bill McCollum

Throughout the state this week, Floridians have been facing higher gasoline prices at the pumps as Hurricane Ike slammed into the Texas coastline. To date, my price gouging hotline has received more than 7,000 calls and emails about the prices, and we have referred more than 2,600 complaints to my investigators to review for possible price gouging.

According to Florida law, price gouging on essential commodities, including gasoline, is prohibited during a declared state of emergency. Price gouging is an unjustified increase in the price of a commodity compared to the average price for the 30 days prior to the declaration of a state of emergency. The statute does permit businesses to pass along cost increases to consumers if those increases can be justified due to higher purchase prices, etc.

With that in mind, my office has issued four subpoenas to the corporate offices of Flying J, Dodge's Gas Stores, Valero and Pilot Travel Centers. We have requested documentation from the companies detailing the purchase prices the companies paid for gasoline sold at their Florida retail stores because we want to determine whether these increased prices are justifiable by the companies. As Florida's Attorney General, I will simply not tolerate gouging our consumers out of sheer greed.

My office continues to work closely with the Department of Agriculture and Consumer Services as we strive to protect Floridians from price gouging. Reports of price gouging should be reported to my fraud hotline, 1-866-966-7226.

CyberCrime Update

An Orange County college student on charges of child pornography possession. Ryan Alexander Conrad was arrested today by law enforcement officers with the Attorney General’s CyberCrime Unit and the Orange County Sheriff’s Office.

Attorney General McCollum announced a new partnership with the Florida Association of School Resource Officers (FASRO) that allows school resource officers throughout the state to present the Attorney General’s CyberSafety Education program in their schools. This partnership provides Florida’s middle and high schools with hundreds of trained CyberSafety presenters who will also assist principals with scheduling presentations to maximize student attendance. School Resource Officers allow students to connect with an in-house expert in whom they can confide if they’ve been victimized online.

A Pinellas County man on charges of promoting the sexual performance of a child. Christopher Bobo was arrested today by law enforcement officers with the Attorney General’s CyberCrime Unit, the Pinellas County Sheriff’s Office and the Largo Police Department.

A Seminole County man on charges of child pornography possession. Dewey Ernest Cruse Jr. was arrested today by law enforcement officers with the Attorney General’s CyberCrime Unit and the Longwood Police Department.
Consumer Protection

Attorney General McCollum issued a series of subpoenas to four companies seeking information about reported increases in the price of gasoline throughout the state. The subpoenas request documentation from the companies detailing the purchase prices the companies paid for gasoline sold at their Florida retail stores. The Attorney General issued the subpoenas after receiving more than 350 complaints about gasoline price gouging over a four-day period.

Attorney General McCollum released the following statement regarding his office’s ongoing investigations into allegations of gasoline price gouging:
“Today, investigators with my Economic Crimes Division are reviewing the 186 complaints we have received about gasoline price gouging in multiple locations throughout the state. The investigators have been contacting station owners and requesting documentation on the nature of the price increases to determine whether the increases in costs being passed along to consumers are justifiable.
Criminal Proceedings

A Ohio man has been re-arrested on charges that he exploited his disabled and now deceased grandmother by stealing more than $23,000 from her. Jason M. Schnegg was arrested by the U.S. Marshal’s Fugitive Task Force and the Columbus, Ohio Police Department on a warrant from the Attorney General’s Medicaid Fraud Control Unit.

A Manatee County caregiver has been taken into custody on charges she physically abused an elderly resident of a Bradenton care facility. Gerda Tervil was arrested by law enforcement officers with the Attorney General’s Medicaid Fraud Control Unit and the Manatee County Sheriff’s Office.
Civil Litigation

Attorney General McCollum today announced that his office has sued ten companies and fifteen individuals for their alleged roles in a significant mortgage fraud scheme in Central Florida. The ring obtained more than $37 million in mortgage loans for at least 60 home purchases and siphoned off more than $6 million of those loan proceeds for their own use. The lawsuit was filed yesterday in Orange County Circuit Court by the Attorney General’s Mortgage Fraud Task Force.

Attorney General McCollum sent a letter to the Honorable Philip N. Hogen, Chairman of the National Indian Gaming Commission, requesting that Chairman Hogen order the Seminole Tribe of Florida to immediately cease the illegal class III gaming activities in Florida.
